California Files Lawsuit Against Nation’s Largest Chain of Senior Living Communities

As reported by Jessica Silver-Greenberg in an article published in the New York Times on Monday, March 15, 2021, the State of California filed a lawsuit against Brookdale Senior Living, the nation’s largest chain of senior living communities.

Led by California’s Attorney General, Xavier Becerra, and supported by other state prosecutors, the lawsuit, filed in the Superior Court of California, accuses Brookdale Senior Living of submitting false information to the Medicare ratings program, essentially manipulating the federal government’s nursing home ratings system.

Says Silver-Greenberg, “The lawsuit is among the first of its kind…The system assigns stars – one being the worst, and five being the best – to the nation’s more than 15,000 nursing homes.”

Silver-Greenberg goes on to explain that this rating system is, “powered by largely unaudited data submitted by nursing homes, including the amount of time nurses spend with residents, and in-person examinations by state health inspectors.”

The lawsuit exposes the ratings system’s flaws after the false reporting left nursing homes vulnerable after the COVID-19 pandemic swept the nation last year. The higher ratings received by Brookdale Senior Living misled residents and their loved ones of the quality of care that they’d received in the facilities from staff members, and this came at the cost of much-needed care to Brookdale residents across the nation who needed every bit of the care that was advertised by Brookdale when Coronavirus hit and put millions of the nation’s elderly at risk.
