In January 2020, Kristensen LLP filed a lawsuit in federal court against Silver Reign Gentlemen’s Club (“Silver Reign”) for violating employment laws. Silver Reign is located in West LA at the intersection of Bundy and Olympic.
The lawsuit alleges that Silver Reign and its owners and management violated the Fair Labor Standards Act (FLSA) by misclassifying the dancers as employees. Approximately 20 United States District Courts and Circuit Courts have found these arrangements illegal. Clubs do not get a get out lawsuit free card by forcing dancers to sign “independent contractor” agreements.
Some clubs even claim dancers are entering into a lease and the dancers are tenants. One federal judge recently described such arguments in stark disagreement: The notion that Plaintiff rented floor space is absurd – Defendants’ silly attempt to redefine reality to avoid the consequences of their conduct.
Clubs like Silver Reign also force dancers to pay house fees. In America, forcing someone to pay to work is called a kickback.
