Protests have become part of our everyday life. Protests erupt across the world every day, every hour. Some are peaceful and the only injury you can suffer is aching in the lower back from all the standing.
Other protests, meanwhile, can result in minor or severe injuries or even fatalities. This was the case in Charlottesville, Virginia, in August, when 38 people were injured and three protesters died.
While protests are not so common in Los Angeles (the city has recently banned pepper sprays, tiki torches, gas masks and other items in a bid to make protests safer), violent crimes and assaults in LA have jumped for third straight year.
Statistics showed last December that robberies were up by 13% and aggravated assaults were up by 10% compared with the same period in 2015.
Protests that cause injuries and assaults have two things in common: (1) someone must be held accountable for your injuries and damages, and (2) you need an experienced personal injury attorney to seek the recovery you deserve.
Here at Kristensen Weisberg, LLP, we’ve helped protest and assault victims recover millions of dollars in compensation from their perpetrator(s). At our Los Angeles office, we take up an aggressive approach to help you win an assault lawsuit or personal injury claim caused a protest.
Many assault victims don’t realize this, but the perpetrator is not the only party that can be held accountable for your injuries, damages, and losses.
Depending on the circumstances of your particular case, you may pursue a premises liability claim against the owner of the property where the assault took place if he/she failed to provide all safety measures to prevent robberies, sexual assaults, batteries, and other violent crimes and assaults.
If the assault took place in a public place in Los Angeles or any other city in our country, you can hold LA partly accountable for your injuries, damages, and losses if the city was negligent in providing adequate security (poorly lit alley, only one way to run away from the perpetrator, etc.).
You’re entitled to maximize the compensation if the assault took place at a nightclub, bar, parking garage, or another property that is supposed to be guarded by ample security.
Things get tricky if you were injured in a protest because, in order to seek the recovery of your injuries and damages, you’ll have to prove that you were hurt due to the neglectful or violent actions of another person or party.
As in the case of assault, you may be entitled to pursue a premises liability claim against the owner of the property where the protest took place, or Los Angeles city if the protest was held in a public place and the city failed to take up all safety measures.
Free speech should be protected by law, but violence never is. Our finest personal injury attorneys at Kristensen Weisberg, LLP will fight tooth and nail to help you achieve your goals and compensation both in the courtroom and behind the scenes.
