On August 7, 2015, the California Court of Appeal issued its ruling upholding the trial court’s denial of St. John of God Retirement & Care Center’s Motion to Compel Arbitration. A copy of the Opinion can be downloaded here. The lawsuit arises from the improper administration of the diabetic drug, Glipizide, to Ella McKennis on August 30, 2012. Ella McKennis was not diabetic. The drug knocked her into a five day coma. The delays from the appeal prevented Ms. McKennis from seeing her day in Court as she passed during the 18 plus months of appellate litigation. Nevertheless, her surviving children are still pursing her claim to get justice for Ella and prevent future incidents at St. John of God Retirement & Care Center. On the Medicare.gov website, the nursing home only received one of five stars for health inspection and two of five stars for overall rating. St. John of God Retirement & Care Center (“St. John of God”) is a nursing home located at 2468 S. St. Andrews Place, Los Angeles, California 90018.
