Kristensen LLP File Suit over DMAA laced Supplements against GNC, Vitamin Shoppe, Amazon, DPS Nutrition & Nutrex

Los Angeles, CA – Kristensen LLP announced they, along with the law firms Rheingold, Valet, Rheingold, McCartney & Giuffra LLP, and the Gansen Law Group PC, have filed a complaint and demand for a jury trial in the Superior Court of New Jersey Law on behalf of their client, Alfred Westermajer, alleging that General Nutrition Centers (GNC),, Vitamin ShoppeDPS Nutrition and Nutrex continued to market and sell “Hemo Rage” and “Lipo-6,” dietary supplements which contained an amphetamine derivative drug dimethylamylamine (DMAA), claiming it was safe and natural despite being warned by the FDA that DMAA was in fact dangerous. The complaint alleges that Westermajer suffered neurological and physical damage as a result.

“It is outrageous that these supplement makers and vendors knowingly sold and marketed ‘Hemo Rage’ and ‘Lipo-6’ as ‘natural and safe’ with full knowledge that the FDA had deemed them dangerous,” said John Kristensen, attorney for Westermajer. “Instead of recalling the product, they boosted the marketing with fantastical claims of benefits. As a result, my client has suffered a neurological breakdown, cannot sleep for more than a few hours a day and will have to use a catheter for the rest of his life!”

“We intend to prove that the conduct of the defendants in this case was unseemly and indecorous, motivated only by a desire to push as much of this product as possible on an unsuspecting public,” said Christopher J. Gansen, also an attorney for Westermajer. “We intend to prove that the defendants made a conscious decision to sell these DMAA products even after they were told in no uncertain terms how dangerous they are.”

The case is Westermajer v. Nutrex Research Inc. et al, case number L-1210-15 in the Superior Court of New Jersey, County of Hudson Civil Division.
