Kristensen Weisberg, LLP Sues Wal-Mart; Yifang USA After Home Destroyed by Fire from Exploding NextBook Tablet

Los Angeles, CA - Kristensen Weisberg, LLP announced they, along with the Rossman Law Group PLLC, have filed a complaint and demand for a jury trial in the Superior Court of California, County of Los Angeles on behalf of their client, Anna Munson, alleging negligence and failure to warn/negligent recall on the part of Yifang USA Inc., Yifang Inc. and WAL-MART STORES, Inc. The complaint alleges that on February 23, 2015, after a Nextbook Tablet manufactured by Yifang was purchased from Wal-Mart it's battery exploded as Ms. Munson slept, severely injuring Ms. Munson and burning her home to the ground.

Kristensen Weisberg File Class Action Lawsuit Against Maker of SneakPeek Early Gender Test

Los Angeles, CA - On December 29, 2015, Kristensen Weisberg, LLP and the Texas-based Mazzola Law Firm, PLLC, filed a class action law suit in the United States District Court for the Southern District of California against Gateway Genomics, LLC, creator of the SneakPeek early detection gender test. The Complaint alleges nine causes of action based on fraud, breaches of warranty, false advertising, and other violations of various consumer protection statutes. Gateway Genomics claims that its SneakPeek in-home blood test can detect the gender of a baby with 99% accuracy, as early as nine weeks into a pregnancy. They charge expecting families a premium - $79 (previously $99) for the standard test, or $169 for the FastTrack test - in order to learn the gender of their child several weeks earlier than they would be able to using traditional methods like a sonogram. However, the test, which has not been cleared or approved by the FDA, has recently come under scrutiny, and many believe that it is based on flawed science and is far less accurate than advertised. Numerous families across the country who used the SneakPeek test, only to discover that their test results were incorrect, can attest that SneakPeek's accuracy may be far closer to a coin flip than the 99% advertised by Gateway Genomics. Even if SneakPeek correctly identified the gender of your baby, Gateway Genomics should not be allowed to charge a premium for a blood test that might be as reliable as a magic 8-ball. Kristensen Weisberg win significant Motion to Remand in DMAA Case against Nutrex and Vitamin Shoppe

Kristensen Weisberg, LLP won a significant ruling on December 15, 2015 in the United States District Court, District of New Jersey.  On March 25, 2015, Kristensen Weisberg, LLP along with the law firms Rheingold, Valet, Rheingold, McCartney & Giuffra LLP, and the Gansen Law Group PC, have filed a complaint and demand for a jury trial in the Superior Court of New Jersey Law on behalf of their client, Alfred Westermajer, alleging that General Nutrition Centers (GNC), Amazon.com, Vitamin Shoppe, DPS Nutrition and Nutrex continued to market and sell "Hemo Rage" and "Lipo-6," dietary supplements which contained an amphetamine derivative drug dimethylamylamine (DMAA), claiming it was safe and natural despite being warned by the FDA that DMAA was in fact dangerous. The complaint alleges that Westermajer suffered neurological and physical damage as a result. In October 2015, General Nutrition Centers (GNC), Amazon.com, Vitamin Shoppe, DPS Nutrition and Nutrex filed a frivolous removal of the matter from Hudson County Superior Court in New Jersey to the Federal Court in New Jersey.  The firms promptly prepared and filed a motion to remand. On December 15, 2015, Hon. William H. Walls granted the motion to remand finding that Vitamin Shoppe was not fraudulently joined. The result was predictable.
