A Chinese tour bus operating out of Monterey Park, California rolled over on the 210 freeway near Irwindale on the morning of Thursday, August 22, 2013. KNBC reported on the story here. Da Zhen is one of many tour buses that transports Los Angeles County residents to casinos in Las Vegas and Primm, Nevada. It is unknown how much insurance the bus company maintains. Most importantly will be whether the bus company has sufficient coverage to pay the claims of the 50 passengers injured in the rollover. The issue for the litigants is whether the bus driver is acting as an agent for any of the casinos and they are thus responsible for his actions. John Kristensen successfully defeated a motion by the Gold Strike Casino to dismiss claims by bus passengers in a catastrophic bus accident on I-15. C.R. Bard, Inc. ("Bard") faces approximately 8,000 claims that its Avaulta vaginal mesh devices are defective, injuring and maiming thousands of women throughout the United States. On Thursday, August 15, 2013, the second jury trial in a row came done hard on Bard. Jurors in the U.S. District Court for the Southern District of Virginia awarded plaintiff Donna Cisson $2,000,000.00. $1,750,000.00 of the award was allocated to punitive damages. Not surprisingly, Bard's lawyers reflexively argued they will appeal. The decision comes on the heels of a July 2012 verdict in Kern County Superior Court in Bakersfield, California, where a jury ordered Bard and a doctor to pay $5,500,000.00 to compensate Elaine Houghton. Kern County is known for its conservative jury awards. With two multi-million dollar verdicts and another 8,000 cases coming down the pipeline, the reserves Bard's insurance carriers will allocate, or allocated, is likely substantial. Kristensen Weisberg, LLP represents scores of women against manufacturers for defective vaginal mesh implants. If you have any questions, please feel free to contact our office at your convenience.
